Terms of Service for In the Dressing Room

These Terms of Use (“Terms”) govern your access to and use of the mobile application In the Dressing Room and related services (the “Service”) offered by Terra et Vita Limited (“Terra et Vita”, “we”, “our”, or “us”). We are a private limited company registered with the Cyprus Registrar of Companies under registration number ΗΕ 340951, with registered office at 26 Nikis, Transafrica House, 1086, Nicosia, Cyprus.

These Terms constitute a legally binding agreement between you and Us. Please read them carefully.

By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree to these Terms, do not use the Service. 

• Eligibility

To use the Service, you must be at least 14 years old (or the minimum age for consent to use online services as required by applicable laws in your country). If you are under 18, you may only use the Service with the consent and supervision of a parent or legal guardian, where required by law. 

• Account Registration 

To access the Service, you may need to create an account. You agree to provide accurate, complete, and up-to-date information. You are responsible for safeguarding your account credentials. 

You must not create an account using false information or impersonate another person or entity. You are responsible for all activity that occurs under your account.

• Use of the Service 

You agree to use the Service only for lawful purposes. You will not:

• Post or share offensive, defamatory, or illegal content
• Infringe on the rights of others
• Use the Service to spam or harass others
• Attempt to reverse-engineer or disrupt the Service
• User Content 

4.1 You retain ownership of content you submit to the Service (the “User Content”). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with providing, improving and promoting the Service. You may revoke this license at any time by deleting your content or your account, unless retention is required by law or necessary for legal proceedings. 

4.2 You are responsible for your User Content and warrant that you have all necessary rights to share it. 

4.3 When you post reviews or other content on the Service, we are hosting such content and you are solely and fully responsible for such content. You expressly acknowledge and warrant that such User Content is lawful and in compliance with these Terms. 

Notwithstanding anything else provided in the Terms, the following is an indicative and non-exclusive list of content that is expressly prohibited on the Service:

• Content that is unlawful under any law or regulation, including content that contains personal insults, discrimination, slander, obscene language or other related unlawful content
• Content that is discriminatory or inaccurate 
• Spam content
• Viruses or other malicious software
• Hidden advertisements for any service or product
• Unrelated content, i.e. content that is not related to the Service 
• Content that violates these Terms
• Content that infringes the intellectual property rights of Terra et Vita or any third party
• Links leading to any unlawful or prohibited content 

4.4. We may, though not obliged to, take automated moderation measures to identify and take down unlawful or prohibited content, by using appropriate automated filters or similar automated procedures.

4.5 Unlawful or prohibited User Generated Content will be subject to manual deletion without notice, upon receipt and examination by Us of a complaint or other notification by a third party or upon receipt of a relevant order by a competent judicial or administrative authority.

4.6 Unlawful content reporting 

We take claims of unlawful content on the Service, including claims of infringement of intellectual property rights seriously. If you believe that any content accessible on or from the Service is unlawful or infringes on your rights under applicable law, you may request its removal by submitting written notification to us at info@inthedressingroom.com or by post at our mailing Address Nikis 26, Transafrica House, 1086, Nicosia, Cyprus.

Your notice must include adequate information to allow us to identify the offending or infringing material and the basis for the claim 

• Intellectual Property 

All content provided by us, including designs, logos, and trademarks, is our property or licensed to us. You may not copy, reproduce, or distribute our content without our prior written consent. 

• Termination 

We reserve the right to suspend or terminate your access to the Service at our sole discretion, with or without notice, for conduct that violates these Terms or is otherwise harmful. We may also suspend your access where required to comply with legal obligations or the request of competent authorities.

• Disclaimers 

The Service is provided “as is” and “as available.” We make no warranties, express or implied, regarding the accuracy, reliability, or availability of the Service. Nothing in these Terms affects any statutory rights you may have as a consumer under applicable law.

• Liability 
  • Exclusions and Limitations 

To the fullest extent permitted by law, Terra et Vita excludes all liability for: 

• Loss of profit, loss of business, loss of revenue, loss of anticipated savings, or loss of use or value; 
• Any indirect, special, or consequential loss arising out of or in connection with the use of the app;
• Any loss or damage arising from the use of third-party services integrated with the app. 
  • Cap on Liability 

Except in respect of death or personal injury caused by negligence, fraud, or fraudulent misrepresentation (for which no limitation applies), the total liability of Terra et Vita under or in connection with these Terms of Use shall not exceed the total fees (if any) paid by the user for the Service in the 12 months preceding the claim. 

• Non-Excludable Liabilities 

Nothing in this clause shall exclude or limit liability for any matter that cannot be excluded or limited under applicable law, including liability under applicable Law. 

• User Responsibility 

You are solely responsible for the consequences of your use of the Service. You agree to use the platform in compliance with applicable legal and regulatory provisions, as well as these Terms. You are also solely responsible for any content you publish on the Service. 

In the event of a legal claim or judgment against Terra et Vita resulting from your posting of any unlawful content or otherwise resulting from your use of the platform, you agree to fully indemnify and hold harmless for any associated damages and costs, including but not limited to reasonable legal fees, judgments, and compensation.

• Data Protection 

We process personal data in compliance with the General Data Protection Regulation (GDPR) and the Cyprus Law providing for the Protection of Natural Persons with regard to the Processing of Personal Data and for the Free Movement of such Data of 2018, as amended from time to time. • Changes to the Terms 

We may update these Terms from time to time. We will notify you of changes by updating the date above and, if significant, by providing notice through the Service. Your continued use of the Service after such changes constitutes your acceptance of the updated Terms.
